After much thought, she decides to buy self defence tools. Mmesoma buys a small purple stun gun from an online vendor. The device looks small, harmless, just like a flashlight.
Months later, on an international trip, while boarding the flight, airport security stopped her. Why? The self defence device– A stun gun was found in her luggage. Mmesoma did not know that the legal status of stun guns, tasers, and pepper spray varies significantly depending on where you live. Depending on where you are carrying one without understanding the law can lead to arrest, fines, or worse.
Before you buy or carry any self-defence device, here are the important legal points you must know.
What Are Stun Guns, Tasers, and Pepper Sprays?
They are known as self defence devices, although often grouped together, these devices differ:
- Stun Guns: Deliver an electric shock through direct contact.
- Pepper spray: Releases a chemical irritant that temporarily impairs vision and breathing.
- Tasers: Shoot barbed probes that transmit an electric charge from a distance.
Despite their non-lethal label, many jurisdictions regulate them as weapons.
Why the Legal Status of Stun Guns, Tasers, and Pepper Sprays Matters
People automatically believe that these tools are legal because they are labelled and marketed as self defence gadgets. However, the law is different in various jurisdictions and not always treat them as harmless safety devices.
In some countries, they are classified as prohibited weapons while in others they are legal but with restrictions. Carrying such devices into some countries can put you in some legal trouble. Understanding the legal status of stun guns, tasers, and pepper spray protects you from unintended criminal liability.

Legal Status in Different Jurisdictions
We’ll be examining the law in a few jurisdictions in comparison with Nigeria.
United States of America(Stun Guns, Tasers, and Pepper Sprays)
In the United States, the use of stun guns and pepper spray are generally legal for civilians to possess across the U.S., but regulations vary significantly by state and municipality. Pepper spray is legal in all 50 states, though some have restrictions on size or strength. Stun guns are legal in most states, with some having stricter regulations including bans or permitting requirements. Additionally, local laws may prohibit carrying these devices in schools, airports, or government buildings.
United Kingdom
In the United Kingdom, both stun guns and pepper spray are classified as prohibited weapons. It is illegal for civilians to possess, carry, buy, or sell them. Possessing these items can result in severe penalties, including imprisonment. Only police officers are authorized to use specific, authorized sprays.
Canada(Stun Gun, Taser, and Pepper Sprays)
In Canada, stun guns, tasers and pepper spray designed for use against humans are prohibited weapons, making their possession, sale, or carrying for self defence illegal under the Criminal Code.
While bear spray is legal for animals, carrying it for protection against people is a criminal offence. Violations can lead to severe penalties, including jail time, fines, and a criminal record.
Nigeria
Nigerian law does not always mention these devices expressly. The legal status of stun guns, tasers and pepper spray are ambiguous and often disputed. Although they are balanced with constitutional self-defense rights against police interpretation of “offensive weapons.”
They may still fall within broader weapons regulations.
The Firearms Act
The primary legislation regulating weapons in Nigeria is the Firearms Act.
Although the Act focuses mainly on guns and ammunition, it also regulates certain “prohibited” and “controlled” weapons. Electric shock devices such as stun guns or tasers are not specifically named. However, authorities may interpret them as offensive or controlled weapons depending on their design and intended use.
Importation without authorization can attract serious penalties under customs and firearms regulations. If a device is capable of causing serious bodily harm, it may fall under regulatory scrutiny even if not expressly listed.
The Criminal Code
In Southern Nigeria, including Lagos, offences relating to weapons are governed by the Criminal Code Act. The code criminalizes the unlawful possession of “offensive weapons” and in Section 403B defines “offensive weapon” as
- Any article apart from a firearm made or adapted for use for causing injury to the person
- Intended by the person having it for such use by him and includes anything capable of being used as an offensive weapon.
This definition is important. Even if pepper spray or a stun device is purchased for self-defence, possession may become unlawful if authorities believe it was carried with intent to cause harm unlawfully.
Penal Code
In Northern states, similar provisions exist under the Penal Code, which criminalizes possession of arms in suspicious circumstances.
Again, the issue is not only the device itself but the intent and surrounding circumstances.
Self Defence Under Nigerian Law
Self-defence is recognized under Nigerian criminal law under section 286 and 287 of the criminal code. However:
- The force used must be necessary
- The force must be proportional to the threat
Using a stun gun, taser or pepper spray in a situation where there is no immediate danger could expose a person to assault or unlawful harm charges.
Importantly, the right of self-defence does not automatically legalize possession of a prohibited weapon.
