• A polygamous marriage (if one of the parties is a Nigerian citizen who is already in a monogamous marriage under the Marriage Act).
• A same-sex marriage, as this is not recognized under Nigerian law.
• A marriage that is not valid under the law of the country where it was celebrated due to a failure to comply with formal requirements.

The recognition of a divorce obtained outside Nigeria is governed by a different set of rules, primarily concerning the jurisdiction of the foreign court. The legal implications of divorce abroad depend on whether the foreign court had the authority to dissolve the marriage. Nigerian courts will generally recognize a foreign divorce decree if, at the time the proceedings were initiated, one of the spouses was domiciled in the country where the divorce was granted.

For a Nigerian court to grant a divorce for a marriage that took place abroad, the petitioner must be domiciled in Nigeria. Domicile refers to the country that a person considers their permanent home. The Matrimonial Causes Act makes special provisions for a wife, stating that a deserted wife or a wife who has lived in Nigeria for at least three years before filing for divorce is considered domiciled in Nigeria for the purpose of initiating proceedings.
